The Worker’s Compensation Truth

Truth of workers compensation

People are often worried about getting fired if they hire a lawyer (or even if they don’t) after having a work injury – so what’s the truth and what’s myth? First, Mississippi is an at-will employment state.  What that means is that an employer can terminate an employee for almost any reason, unless it deals with age, sex, race, etc.  Unfortunately a person can legally be fired just for the fact that they got injured at work. But when our firm’s employees get hurt on the job, we want them to get good treatment. That’s what good employers should do.  That’s why...

Workers’ Comp Eligible Under A Contractor?

Hurt on the job contractor

A common question we get from our Workers' Compensation clients is, "Am I eligible for Workers' Compensation if I was injured while working for a contractor or sub-contractor?" The answer is Yes. In Mississippi, if you get hurt on a job site working for a contractor or sub-contractor, in most cases, you are entitled to workers’ compensation.  If the sub-contractor you work for does not have insurance, then the contractor’s insurance is required to kick in.  So don’t be fooled if you are told that workers’ comp does not apply or that there is no insurance available. The law states: § 71-3-7 (6) In...

Car Fatalities by Phone Distraction Inaccurate

fatalities

According to a new report from Bloomberg, the data and information that is out there about cell phone use while driving as well as car fatalities from cell phone use is very inaccurate, and that creates a huge problem. The NHTSA (National Highway Transportation Safety Administration) keeps up with all of the vehicle related fatalities that occur each year in the United States. With that information from NHTSA, lawmakers, journalists, and activists focus their energy around it. Bloomberg’s report found that NHTSA’s data is not reporting correctly the cell phone usage causing fatalities. Recent reports by NHTSA show that over the last...

Telling the Jury About the Sued Party’s Insurance?

sued

Why don’t lawyers tell the jury whether the person being sued has insurance?   Whether a person or company has insurance is not relevant to whether they are liable or how much the award should be.  We all walk around with bias in some form or fashion.  You may think the refs are always against your favorite team and you probably like your Mom more than other people.  There is nothing wrong with having inherent human bias.  But in a courtroom, the rules are set up to try to take emotion and sympathy away from juries, despite that fact that each member...

Do I Have to Set Up a Guardianship for Settlement

guardianship

Do I have to set up a guardianship for settlement of my child's case? Yes.   In Mississippi, an individual is considered a minor until they are 21 years old.  A guardianship is required to be set up when a minor is involved in an accident, is to receive funds due to a parent’s wrongful death, or many other circumstances when a lawsuit is going to be filed or a case is going to be settled and the minor will receive funds. The purpose of the guardianship is to protect the minor’s funds from others until they turn 21 and can decide how they...

deposition

A deposition is an oral statement of a witness taken under oath. Depositions are taken of parties, witnesses and others who may have knowledge about a specific case. Depositions are taken in all types of cases, from car wrecks to workers compensation matters to family law matters.  Depositions help the parties to learn the facts of a case before it goes to trial. Depositions also help the attorneys on both sides evaluate what type of witness a plaintiff, defendant or witness may be at trial.   Plaintiffs in cases such as those listed above are asked a variety of questions, many of...

How Your Case Can Be Affected By Social Media

social media

Social media can affect your case in many ways. Imagine that you are unloading your groceries and you see a strange man in the bushes holding a video camera.  He quickly walks to his van as soon as the two of you make eye contact.  For many years insurance companies have been hiring private investigators to follow injured workers in hopes of “catching” them doing something their doctor has told them not to do or doing something that they state causes them pain.  Even something innocent can be mis-characterized by a private investigator.  Some insurance companies still use this tactic.  Injured...
