Asylum and Withholding of Removal

Asylum is a an option that foreign nationals may utilize to legally remain within the United States due to reasons related to their home country such as past persecution or the fear of future persecution for things related to ethnicity and race, sexual orientation, political ideology, religion, membership in questionable social groups and more. Foreign nationals who are currently located or will soon be arriving in the United States are eligible to apply for Asylum, either by asking for Asylum at the point of entry for arriving foreign nationals, or filing an Application for Asylum as well as a Withholding of Removal within one year of arrival. If you have failed to file within one year, if you have been previously denied asylum or if you can be relocated to a different country that has been deemed safe, then it will not be granted.

The Asylum Application Process

The asylum application process can be complicated and confusing, especially for foreign nationals who are not familiar with similar processes and procedures within the United States government. To allow for the greatest opportunity at success, you are encouraged to enlist the services of an experienced immigration attorney who can guide you through the process as smoothly as possible while providing you with a level of understanding of your situation that you may not have otherwise been able to find.

There are a number of grounds on which asylum may be granted for fear of persecution based upon:

  • Race
  • Religion
  • Nationality
  • Political opinion
  • Membership in a social group
  • Domestic violence
  • Homosexuality
  • Gang or criminal violence with a political or social group component

One year after you have received asylum your lawyer can help you apply for permanent residency in the U.S.
