Insurance Questions After a Car Wreck

Car wreck

Insurance Questions After Dealing With a Car Wreck.   What happens if I have a car wreck and I don’t have car insurance?   In Mississippi, the law requires that every person driving a car be able to provide proof of insurance coverage.  Failure to have insurance can subject you to penalties and fines, but it is much worse if you have a car wreck that is your fault.    You can always be sued whether you have insurance or not, but without insurance you would liable for all of the damages.  This could subject you to garnishment and/or seizure of your assets.  Also, you...

The Worker’s Compensation Truth

Truth of workers compensation

People are often worried about getting fired if they hire a lawyer (or even if they don’t) after having a work injury – so what’s the truth and what’s myth? First, Mississippi is an at-will employment state.  What that means is that an employer can terminate an employee for almost any reason, unless it deals with age, sex, race, etc.  Unfortunately a person can legally be fired just for the fact that they got injured at work. But when our firm’s employees get hurt on the job, we want them to get good treatment. That’s what good employers should do.  That’s why...

Workers’ Comp Eligible Under A Contractor?

Hurt on the job contractor

A common question we get from our Workers' Compensation clients is, "Am I eligible for Workers' Compensation if I was injured while working for a contractor or sub-contractor?" The answer is Yes. In Mississippi, if you get hurt on a job site working for a contractor or sub-contractor, in most cases, you are entitled to workers’ compensation.  If the sub-contractor you work for does not have insurance, then the contractor’s insurance is required to kick in.  So don’t be fooled if you are told that workers’ comp does not apply or that there is no insurance available. The law states: § 71-3-7 (6) In...

Telling the Jury About the Sued Party’s Insurance?

sued

Why don’t lawyers tell the jury whether the person being sued has insurance?   Whether a person or company has insurance is not relevant to whether they are liable or how much the award should be.  We all walk around with bias in some form or fashion.  You may think the refs are always against your favorite team and you probably like your Mom more than other people.  There is nothing wrong with having inherent human bias.  But in a courtroom, the rules are set up to try to take emotion and sympathy away from juries, despite that fact that each member...

How Can a Busy Lawyer Do a Good Job?

lawyer busy

Our office handles Mississippi Workers' compensation claims like a team sport.   The attorneys at Chhabra and Gibbs are all experienced when it comes to pursuing injured workers in Mississippi. We are busy lawyers for two reasons-- 1. We can't stand to see injured workers treated unfairly, and 2. we are good at what we do.  You want your lawyer doing the "lawyering", because that is what they know--- whether that be in the courtroom advocating for injured workers, participating in depositions, or drafting motions and briefs that bring attention to their client's issues.  This means that your attorney is  not...

I Want My Case Settled Today

case settle

Settle my case today I am often asked how long it will take to settle a workers compensation or personal injury case. Recently I had a phone call with a prospective client here in Mississippi who was not very nice to our staff members who were trying to help him.  Our staff members were trying to get information to set up the file so one of our Chhabra & Gibbs, P.A. Injury lawyers could review it, but the prospective client insisted that he talk to the Injury lawyer right now and that he was not interested in dragging this out and...

Should I just settle With the Insurance Company?

insurance company

Settle with the insurance company? Many Workers Compensation and Personal Injury cases in Mississippi are settled everyday with no lawyer involvement between an injured person and an insurance adjuster. It makes me cringe to know how easy it is to get good advice from a very skilled and experienced Injury lawyer before signing on that dotted line, yet still people just want to get it over with. I get it. You may be thinking: An Injury lawyer will take most of the money An Injury lawyer probably can't get more for you after fees You don't want to have to go to...
