This is one of the top questions we are asked every day.  There is no easy answer, because each case is different, and there are lots of different factors that play into the way the attorney values the case.

The first thing that affects how much your case is worth is what body part you have injured.  Scheduled member cases such as arms, legs, fingers, toes, etc. are evaluated with a mathematical formula that factors in the amount of weeks assigned to each body part under Mississippi law, the person’s average weekly wage, and the impairment rating as assigned by their treating physician.  Cases where the injury is to the back, neck, or body as a whole, however, are evaluated based on the person’s loss of wage earning capacity.  In other words, the value depends on the person’s ability to go back to doing the substantial acts of similar employment.  Many other factors may affect the value of a person’s claim, such as whether or not they were terminated from their employment as a result of the injury, how much they were making before they were injured, the quality of the job search that they have performed at the request of their attorney, unpaid medical expenses, and their willingness to return to work once released by a doctor. It is also important to consider the value of your future medical treatment.
