FDA’S WARNING TO CONSUMERS

On August 22, 2023, the FDA issued a warning to consumers not to purchase and to “immediately stop” using the Products due to bacterial and/or fungal contamination.

The FDA’s testing “showed the products were contaminated with microbes and were not sterile.” In the Dr. Berne’s products, the FDA found both bacterial and fungal contamination. In the LightEyez products, the FDA found bacterial contamination. For an eye product to be deemed safe for use, the Federal Food, Drug and Cosmetic Act specifically requires the product to be sterile.

INJURIES AND CLAIMS

Bacterial and/or fungal contamination in eye drops can cause serious eye infections and even threaten a person’s vision. Further, these Products contain MSM (methylsulfonylmethane) as an active ingredient. The FDA has not approved any eye drops product that contains MSM as an active ingredient. Thus, even if you have not suffered eye or vision damage, you may have a claim.
