When a tractor-trailer strikes a smaller vehicle, the family may have claims against the truck driver and the trucking company. An unsafe speed truck crash lawyer looks at the driver’s speed, the truck’s data, and the carrier’s records. Two people died in back-to-back tractor-trailer crashes on I-64 in Albemarle County overnight. Police have charged both truck drivers.

What Happened in the Back-to-Back I-64 Crashes?
Virginia State Police said the first crash happened around 11:25 p.m. on Monday, October 26, 2026, at mile marker 108 on westbound I-64, WVIR reported. A Ford hit a deer and became disabled in the right travel lane. A Honda stopped behind the disabled Ford. A westbound tractor-trailer then struck the Honda from behind.
The impact sent the Honda and the tractor-trailer onto the right shoulder and into a ditch. The Honda’s driver, a 19-year-old woman, was ejected and died from her injuries, Cville Right Now reported. The tractor-trailer driver was hurt and taken to a hospital. The Ford driver was not hurt.
Virginia State Police charged the 34-year-old tractor-trailer driver with reckless driving. These charges are accusations, not convictions. The driver is presumed innocent unless a court finds otherwise. State police are still investigating.
About 90 minutes later, at 12:51 a.m. on Tuesday, October 27, a second fatal crash happened one mile west at mile marker 109. Albemarle County Police, Virginia State Police, and Albemarle County Fire Rescue responded, WHSV reported. WVIR reported that this crash also happened in the westbound lanes.
Police said a tractor-trailer struck a vehicle and pushed it into a gooseneck trailer ahead of it. Crews took the vehicle’s driver, a 58-year-old woman from Fishersville, to UVA Health with serious injuries. She later died there.
Police charged the 30-year-old tractor-trailer driver, a New Jersey resident, with felony involuntary manslaughter, failure to obey a highway sign, and driving too fast for conditions, Cville Right Now reported. That driver is held without bond at the Albemarle-Charlottesville Regional Jail. These charges are also accusations, not convictions. The Albemarle County Police Department’s Traffic Unit is still investigating that crash.
What Does Driving Too Fast for Conditions Mean?
A posted limit is the most a driver may go, not a safe speed in every setting. Under Virginia Code § 46.2-861, driving faster than is reasonable for the conditions is reckless driving. Darkness, stopped traffic ahead, and a disabled vehicle in the lane can all call for a lower speed.
Virginia also has a general reckless driving statute at Virginia Code § 46.2-852. Reports have not said which section supports the earlier charge. Drivers must also obey traffic control devices under Virginia Code § 46.2-830. Involuntary manslaughter is a Class 5 felony under Virginia Code § 18.2-36.
Why Is Unsafe Speed So Dangerous for a Tractor-Trailer?
A loaded tractor-trailer can weigh up to 80,000 pounds. It needs far more room to stop than a car. When a truck closes on stopped or slower traffic at night, the driver has little time to react. A car stopped behind a disabled vehicle has nowhere to go.
Federal safety rules address speed directly. 49 CFR 392.2 requires commercial trucks to follow state traffic laws. 49 CFR 392.6 bars a carrier from scheduling a run that would force a driver over the speed limit. 49 CFR 392.14 requires extreme caution and reduced speed when conditions hurt visibility or traction. Reports have not described the weather during these crashes.
Who May Be Responsible in an Unsafe Speed Truck Crash?
A criminal case and a civil claim are separate. A family does not need to wait for the criminal case to end before getting legal advice. An unsafe speed truck crash lawyer also asks whether the driver was working for a motor carrier. That company may be responsible for the driver’s conduct on the job. A carrier can also face claims for poor hiring, training, supervision, or unrealistic schedules. Our article on trucking company liability explains how several parties can share responsibility.
Interstate carriers must carry minimum insurance under 49 CFR Part 387. For a similar crash pattern, see our post on a rear-end semi crash on U.S. 27.
What Rights Does a Family Have Under Virginia Law?
Virginia Code § 8.01-50 allows a wrongful death action when another’s wrongful act or neglect causes a death. The personal representative of the estate brings the claim. Section 8.01-53 lists which family members may share in any award.
Virginia Code § 8.01-244 generally gives two years after the death to file. Exceptions may apply. Virginia also follows contributory negligence. That strict rule can bar recovery if the injured person was even slightly at fault.
How Does an Unsafe Speed Truck Crash Lawyer Build a Case?
A semi’s engine control module can record speed, braking, and throttle before impact. An electronic logging device shows the driver’s hours under 49 CFR Part 395. Dispatch messages can show whether time pressure played a role. Our guide on how federal trucking regulations affect accident claims explains which records matter most.
This evidence can disappear. Carriers repair trucks and return them to service. A truck accident attorney can send preservation letters quickly to the carrier and its insurer.
What Should a Family Do After a Fatal Truck Crash?
Ask the investigating agency for the crash report number. Save medical records, bills, photos, and messages. Write down witness names. Avoid giving a recorded statement to a trucking insurer before getting legal advice.
We are sorry for the families and friends of both women who died on I-64.
