Rear-End Semi Crash on U.S. 27: Can Families Sue the Trucking Company?

Rear-End Semi Crash on U.S. 27: Can Families Sue the Trucking Company?

Often, yes. A rear-end semi crash lawyer looks first at the truck driver and the motor carrier that put the truck on the road. The Polk County Sheriff’s Office says a semi failed to stop for traffic waiting at a red light on U.S. 27 near Frostproof, Florida. A pregnant woman and her unborn baby died.

If you or a loved one was hurt, call Chhabra, Gibbs & Gustavis, P.A. at (877) 317-8005 for a free consultation; early help protects evidence.

What Happened at U.S. 27 and U.S. 98 Near Frostproof?

The crash happened shortly after 5:30 p.m. Saturday, October 17, 2026, at the intersection of U.S. 27 and U.S. 98 in Polk County. FOX 13 Tampa Bay reported the sheriff’s office account. Five vehicles were involved, including two semi-trucks.

Deputies said three vehicles sat at a red light in the right northbound lane. A Honda Civic was first, then a Toyota Corolla, then a Toyota Highlander. A Volvo semi with a trailer was stopped in the left lane beside them.

A 2022 International semi with a trailer was heading north in the right lane. The sheriff’s office said its driver did not stop for the traffic ahead. The truck hit the back of the Highlander at highway speed. That impact pushed the SUV into the stopped Volvo semi and then through the intersection.

The Highlander’s rear passenger area was crushed inward. A 32-year-old Avon Park woman riding in the back seat was taken to a hospital. She and her unborn baby later died, deputies said.

The International then struck the Corolla and pushed it into the Civic. The truck crossed the intersection, ran about 400 feet through a field, hit a fence, and stopped in a ditch. Daily Ridge reported that a Michigan company owned the truck. Its 53-year-old driver was treated and released.

The Corolla’s 37-year-old driver remained hospitalized and was the most seriously hurt survivor. Others were treated or still under care. U.S. 27 stayed closed for about six hours. Investigators have not said why the truck failed to stop, and no charges have been announced.

Who Is Responsible When a Semi Rear-Ends Stopped Traffic?

Every driver must keep a safe following distance and watch for traffic slowing ahead. That duty matters even more for a loaded tractor-trailer. A heavy truck at highway speed needs far more distance to stop than a car.

Florida courts generally presume that the rear driver in a rear-end crash was careless. The truck side can try to rebut that presumption with evidence. Investigators often look at speed, distraction, fatigue, brake condition, and whether the driver saw the signal change.

When a truck driver is working for a carrier, the company usually answers for that driver’s careless driving. A carrier can also face its own claims for poor hiring, training, or maintenance. Our guide on how trucking company liability works explains these claims in more detail.

Which Federal Trucking Rules Matter in a Rear-End Semi Crash?

Interstate truck drivers must follow federal safety rules. Hours-of-service limits in 49 CFR Part 395 aim to keep tired drivers off the road. Federal rules in Part 392 bar texting and handheld phone use while driving. Part 396 covers inspection, repair, and maintenance, including brakes. Part 382 sets drug and alcohol testing.

Reports have not said whether any of these rules played a part here. Still, they shape what a rear-end semi crash attorney asks for. Our article on how federal trucking regulations affect accident claims covers the records that usually matter most. The federal hours-of-service rules are public.

What Rights Do Families Have After a Fatal Truck Crash?

Florida law would govern claims from this crash. Florida’s Wrongful Death Act sets out who may bring a claim and what losses can be recovered. Florida also uses a modified comparative fault rule. A person found more than 50 percent at fault generally cannot recover. States treat the loss of an unborn child differently, and exceptions may apply.

Mississippi works differently. Its wrongful death statute, Miss. Code § 11-7-13, expressly covers an unborn quick child. Under Miss. Code § 11-7-15, Mississippi follows pure comparative fault, so a person can recover even if partly at fault. Our wrongful death lawyer page explains who may file and how these claims work.

Why Should You Call a Truck Accident Lawyer Early?

Truck crash evidence can disappear fast. Tow yards release vehicles. Carriers repair trucks and put them back in service. Electronic data can be written over within days.

A lawyer can send preservation letters to the carrier right away. Those letters ask the company to keep the truck, its engine control module data, electronic logging device records, and any dash camera video. Many newer trucks also have collision warning systems that may record speed and braking in the final seconds.

What Should You Do If a Semi Hits Your Vehicle?

Get medical care and follow every treatment plan. Ask the sheriff’s office or police for the crash report number. Photograph the vehicles and the scene if you can. Write down witness names. Keep medical bills and insurance letters together. Do not give a recorded statement to the trucking company’s insurer before getting legal advice. Our article on evidence that can strengthen an injury claim explains what to save.

We are deeply sorry for the family who lost a mother and her baby, and we hope everyone injured recovers.
