Often, yes. When a truck driver is accused of driving impaired, a truck driver DUI accident lawyer looks at the driver, the company behind the truck, and the alcohol rules for commercial drivers. Memphis police say a tractor-trailer and an SUV collided early Sunday in Hickory Hill. The SUV driver died, and the truck driver now faces a DUI charge.

What Happened on Riverdale Road in Hickory Hill?
The crash happened just before 4 a.m. on Sunday, October 11, 2026. It took place near Winchester Road and Riverdale Road in the Hickory Hill area of Memphis, Tennessee. WREG reported the Memphis Police Department account.
MPD said officers came upon a crash involving a tractor-trailer and a white GMC Yukon. Flames had engulfed the SUV. An officer helped the Yukon driver out of the vehicle, but that driver died at the scene.
According to police, a man flagged officers down and said he was driving the tractor-trailer. He told MPD he was heading south on Riverdale Road and turning left onto Riverdale Bend Road when the Yukon collided with his rig.
Officers said they noticed a strong odor of alcohol and glossy eyes. Police said he could not complete two field sobriety tests and stumbled several times. He agreed to a blood draw, and police said those results are pending.
MPD charged the 41-year-old driver with driving under the influence and public intoxication. WREG reported that he posted a $2,500 bond and has a November 19 court date. A charge is an accusation, not a conviction. Police have not named a trucking company or released a final crash report. WREG later reported that the SUV driver’s sister wants tougher charges.
Can a Family Sue the Trucking Company After a DUI Truck Crash?
In many cases, yes. A motor carrier usually answers for a driver who works on its behalf. The company may also face its own claims over hiring, training, supervision, and dispatch. Our guide to how trucking company liability works explains these paths.
Ownership questions matter here. Reports so far do not say who owned the tractor or trailer. They also do not say whether the driver was hauling a load or on duty. Those facts shape which insurance policies apply. Federal rules require interstate carriers to carry minimum liability coverage under 49 CFR Part 387.
What Alcohol Rules Apply to Commercial Truck Drivers?
Federal rules hold truck drivers to a stricter standard than most motorists. Under 49 CFR 392.5, a driver may not use alcohol within four hours of going on duty. Drivers also may not report for duty with an alcohol concentration of 0.04 or higher under 49 CFR Part 382.
After a crash that kills someone, the carrier generally must test the driver for alcohol and drugs under 49 CFR 382.303. Those results, past test records, and hiring files can show whether the company knew about a risk. Our post on federal trucking rules in accident claims covers these records in more detail.
What Evidence Does a Truck Driver DUI Accident Lawyer Need?
A truck driver DUI accident attorney will want the blood test results. Police body camera video and sobriety test findings matter too. Engine control module data can show speed and braking before the turn. Electronic logging device records can show how long the driver had been on duty. Nearby business cameras may capture the turn and the signal.
Some of this proof disappears fast. Fire damage can complicate vehicle inspections, and many businesses record over their video within days. A preservation letter asks the carrier to keep the truck, the logs, and its records. Our article on evidence that can strengthen an injury claim explains what families should save.
What Should a Family Do Next?
Request the crash report from the Memphis Police Department. Keep funeral bills, medical records, and insurance letters together. Write down any witness names. Avoid giving a recorded statement to a trucking insurer before getting legal advice, and do not sign a release early.
Tennessee law governs claims from this crash, and its fault and deadline rules differ from Mississippi’s. Tennessee generally gives families one year to file many injury and wrongful death claims, so timing matters. Exceptions may apply. Our wrongful death lawyer page explains how these claims usually move forward.
How Would a Similar Crash Work in Mississippi?
Many North Mississippi families drive Memphis roads every day. In Mississippi, a commercial driver can face DUI charges at a 0.04 alcohol concentration under Miss. Code § 63-11-30. Mississippi also follows pure comparative fault under Miss. Code § 11-7-15. Damages shrink by any share of fault but are not barred. We covered another impaired-driving case in our Biloxi I-110 drunk driving crash post.
We are sorry for the family and friends of the driver who died in this crash.
