A Biloxi drunk driving accident lawyer can help a family learn who may be responsible after a deadly DUI crash. Early on Saturday, October 3, 2026, a Jeep hit an SUV stopped on the shoulder of northbound I-110 in Biloxi. Two people in the SUV died. The Jeep driver now faces two counts of aggravated DUI.

What Happened in the I-110 Crash in Biloxi?

WAFB reported details from a Biloxi Police Department crash report. Around 2:11 a.m., a Chevrolet Trailblazer sat stopped on the right shoulder of northbound I-110. A Jeep Grand Cherokee heading the same way drove onto the shoulder and struck the Trailblazer from behind.

A 48-year-old woman in the Trailblazer died at the scene. Responders took a 43-year-old man to the Biloxi campus of Memorial Hospital at Gulfport, where he later died. The couple lived in the Gonzales, Louisiana, area.

The crash report lists the Jeep driver as a 22-year-old D’Iberville resident. It also indicates the driver had a suspended license at the time. Harrison County jail records show an October 5 arrest on two counts of aggravated DUI. Bond was set at $250,000 per count.

The report does not explain why the Trailblazer was on the shoulder. A criminal charge is an accusation, not a conviction, and the case is still moving through the courts.

Who Is Responsible When a Drunk Driver Causes a Fatal Crash?

The impaired driver is the first person a civil claim looks at. A DUI charge can support that claim, but the civil case does not depend on a criminal conviction.

Other parties may share responsibility in some cases. An owner who lends a car to someone with a suspended license may face a negligent entrustment claim. Our post on what happens when the other driver does not have a valid license covers that issue. Mississippi also allows a narrow claim against a business that serves alcohol to a visibly intoxicated person under Miss. Code § 67-3-73. Exceptions may apply, and nothing in public reports shows where the Jeep driver had been.

Can a Family Seek Punitive Damages After a Biloxi DUI Crash?

Sometimes. Under Miss. Code § 11-1-65, punitive damages require clear and convincing proof of gross negligence or reckless disregard for safety. Courts have treated drunk driving as conduct that may meet that standard. Caps apply, and exceptions may apply.

Mississippi uses modified comparative fault under Miss. Code § 11-7-15. An insurer may argue that a vehicle stopped on the shoulder shares some blame. A person can still recover if their share of fault is 50 percent or less. Any award then shrinks by that share. A Biloxi drunk driving accident attorney can push back on unfair blame.

What Rights Does a Family Have After a Fatal Harrison County Crash?

Mississippi allows certain family members to bring one wrongful death claim under Miss. Code § 11-7-13. Depending on the family, that can include a spouse, children, parents, or siblings. The claim can cover medical and funeral costs, lost financial support, and the loss of a loved one’s companionship.

Families who live in another state can still bring a claim for a crash that happened in Mississippi. The general deadline is three years under Miss. Code § 15-1-49, but exceptions may apply. Our Mississippi wrongful death lawyer page explains the process in more detail.

Who Pays When the At-Fault Driver Has Little Insurance?

Mississippi’s minimum liability limits are low, and two deaths can exceed a basic policy quickly. A driver with a suspended license may carry no valid coverage at all. The victims’ own uninsured and underinsured motorist coverage may help fill the gap, even under a Louisiana policy. Our uninsured and underinsured motorist page explains how that coverage often works.

Why Should You Preserve Evidence After a Drunk Driving Wreck?

Proof can fade even when police make an arrest. The Jeep and the Trailblazer may hold airbag module data on speed and braking. Tow yards may release or salvage wrecked vehicles. Highway cameras and nearby business video often record over within days.

Receipts, bar tabs, and witness accounts about where the driver had been can matter to a civil claim. A lawyer can send preservation letters to owners, insurers, and any business that may hold records. Families who search for a Biloxi DUI crash lawyer often need this step first.

What Should You Do If This Happened to Your Family?

Ask the Biloxi Police Department for the crash report number and the investigating officer’s name. Find out which tow yard has both vehicles and ask the tow yard to hold them. Keep hospital, funeral, and insurance letters in one folder.

Do not give a recorded statement to any insurer before you get legal advice. Our Biloxi car accident lawyer page has more on crashes along the Coast.

We are sorry for the families who lost two loved ones in this crash.
