Semi Hits Worker at Louisa Gas Station: Can the Family Sue?

Semi Hits Worker at Louisa Gas Station: Can the Family Sue?

A semi truck pedestrian accident lawyer often hears one question first after a fuel-stop death: can the family sue the trucking company? In many cases, yes. Louisa police say a tractor-trailer leaving the fuel pumps hit and killed a maintenance worker on Monday morning. The worker’s family may have a wrongful death claim against the driver and the company behind the truck.

What Happened at the Louisa Gas Station?

The crash happened shortly before 6 a.m. on Monday, October 12, 2026. It took place at a gas station on Falls Creek Drive along U.S. 23 in Louisa, in Lawrence County, Kentucky. The Louisa Police Department said the semi hit the pedestrian as it left the station’s fuel pumps, WCHS reported.

Police told WSAZ that the pedestrian was a maintenance worker. The worker was checking diesel containers because of the rain. Police said the driver hit the worker while pulling out after fueling and did not realize it. The worker died at the scene.

A station employee found the worker around 5:50 a.m. and reported it, police said. A few minutes later, a customer came upon the worker and called 911 again.

Officers reviewed video footage and used it to find the trucking company. They then reached the driver, who returned to the scene right away, according to WSAZ. LEX 18 reported that investigators were processing the scene. Police have not announced charges, and the investigation continues.

Who Is Responsible When a Semi Hits a Pedestrian at a Fuel Stop?

Truck drivers must watch for people around their rigs. Fuel stops mix trucks, cars, customers, and workers in a tight space. Before a semi pulls away, the driver should check mirrors and blind spots. Rain and the dark hours before sunrise make that check even more important.

Responsibility often reaches past the driver. A trucking company usually answers for a driver working on its behalf. The carrier may also face claims over training, supervision, or unsafe schedules. Our guide to liability in an 18-wheeler accident explains how these claims work.

What Federal Trucking Rules Apply in a Semi Truck Pedestrian Crash?

Interstate carriers follow Federal Motor Carrier Safety Administration rules. Under 49 CFR 393.80, trucks need two outside mirrors. Those mirrors must show the driver the view to the rear along both sides of the truck. Carriers must also check driver qualifications under Part 391.

Hours-of-service limits in Part 395 apply as well. In any early morning crash, lawyers compare the driver’s logs with the trip timeline. That review shows whether the driver had the required rest. A semi truck pedestrian accident attorney would also ask how the carrier trained the driver to clear the area before moving.

For-hire interstate trucks hauling general freight must carry at least $750,000 in liability coverage under 49 CFR 387.9. More than one policy may apply. Our post on how federal trucking regulations affect accident claims covers these rules in more depth.

Can a Worker’s Family Get Workers’ Comp and Also Sue the Trucking Company?

Often, yes. Reports say the worker was checking diesel containers when the truck hit. If the worker was on the job, workers’ compensation may pay death benefits through the employer. Those benefits usually take the place of a lawsuit against the employer itself.

A trucking company is different. When an outside driver causes a death, the family may bring a separate third-party claim. That claim can cover losses workers’ comp does not pay, such as the loss of a loved one’s companionship. Our post on filing an injury lawsuit and a workers’ comp claim for the same accident explains the basic idea.

Kentucky law would likely govern a claim from this crash. Kentucky sets its own wrongful death procedures and filing deadlines, and some deadlines are short. Exceptions may apply, so families should get advice early.

Why Call a Semi Truck Pedestrian Accident Lawyer Early?

Video sits at the center of this case. Police used footage to find the truck company. Many businesses record over their video on a set schedule, so families should not assume it will stay available.

Semis also store data. Electronic logging devices track driving hours. Engine control modules can record speed and braking. Some trucks carry dash cameras that face the road or the cab. Fuel receipts and dispatch records can show when the truck arrived and left.

A semi truck pedestrian accident lawyer can send preservation letters to the carrier and the station right away. Federal rules require carriers to keep inspection and maintenance records under 49 CFR Part 396. Our article on evidence that can strengthen an injury claim explains what to save.

What Should a Family Do After a Fuel-Stop Truck Accident?

First, ask the Louisa Police Department for the report number. Next, keep funeral bills, medical records, and insurance letters in one place. Write down the names of anyone who saw the scene or spoke with police. Do not give a recorded statement to any insurer before getting legal advice, and do not sign a release early.
