Two people, including a 10-year-old girl and a 51-year-old Columbus woman, were killed in a two-vehicle crash on Highway 50 in Clay County on Monday morning, October 5, 2026. Three other children were also taken to hospitals following the crash near West Point.

Our thoughts are with the families who lost loved ones and with the children, parents, and other family members affected by this heartbreaking crash.

The crash remains under investigation, and authorities have not yet released a cause or determined who was at fault.

What Happened in the Clay County Highway 50 Crash?

According to information from the Clay County coroner and Mississippi Highway Patrol reported by WTVA, the crash happened at approximately 7:46 a.m. Monday, October 5, at the intersection of Oak Crest Circle and Highway 50 in Clay County near West Point.

Two vehicles were involved in the collision.

A 51-year-old woman from Columbus was driving one vehicle. A 10-year-old girl was a passenger in the other vehicle. Both were pronounced dead at the scene.

Three other juveniles were transported to area hospitals for treatment. Their conditions have not been released.

The Clay County coroner’s office, Mississippi Highway Patrol, and Clay County Sheriff’s Office are investigating the crash.

At this time, authorities have not publicly released several important details, including:

  • Which direction each vehicle was traveling
  • Whether either vehicle was turning or entering Highway 50
  • The makes and models of the vehicles
  • Who was driving the second vehicle
  • Which vehicle the injured children were riding in
  • What caused the collision
  • Whether any citations or criminal charges will be issued

As the investigation continues, additional information may become available.

Why Intersection Crashes Can Cause Serious Injuries

Highway intersections can be especially dangerous because vehicles traveling at highway speeds may suddenly encounter vehicles turning, entering the roadway, or crossing traffic.

The severity of a crash can depend on the angle of impact, vehicle speed, vehicle size, occupant position, and whether the vehicle’s safety systems performed properly.

Children involved in serious crashes can suffer injuries including:

  • Lesiones cerebrales traumáticas
  • Lesiones internas
  • Spinal injuries
  • Huesos rotos
  • Soft-tissue injuries
  • Abdominal injuries
  • Emotional and psychological trauma

Some crash injuries may not be immediately obvious. Parents and guardians should follow medical professionals’ recommendations and seek additional care if a child develops new or worsening symptoms after a crash.

What Could Have Caused the Highway 50 Crash?

The cause of the October 5 crash has not been released.

Investigators may examine a number of potential factors when determining how a collision occurred, including:

  • No ceder el paso
  • Running a stop sign or traffic signal
  • Exceso de velocidad
  • Conducción distraída
  • Conducir bajo los efectos del alcohol o las drogas
  • Fatiga
  • Poor visibility or sun glare
  • Roadway design
  • Obstructed sight lines
  • Vehicle defects or mechanical problems

Investigators may also examine photographs of the crash scene, physical evidence, witness statements, vehicle damage, surveillance video, 911 calls, and available vehicle data.

Because the investigation is ongoing, it would be premature to assign responsibility for this crash based only on the initial reports.

Who Can File a Wrongful Death Claim When a Child Dies in Mississippi?

When a child dies because of another person’s negligence, Mississippi law may allow the child’s surviving family members to pursue a wrongful death claim.

Mississippi Code Section 11-7-13 addresses wrongful death claims and identifies the individuals who may have an interest in such a claim. Parents are generally among the family members who may pursue a claim following the death of a child.

A wrongful death claim can potentially seek compensation for losses associated with the death, depending on the circumstances of the case.

The family of the 51-year-old woman killed in the crash may also have a wrongful death claim if another person’s negligence caused or contributed to her death.

Because every family situation is different, determining who may pursue a wrongful death claim and how the claim should be handled requires an evaluation of the specific circumstances.

What About the Children Who Survived the Crash?

The three children who survived the crash may have their own personal injury claims if another person’s negligence caused the collision.

Because the injured children are minors, their parents or legal guardians generally handle their claims on their behalf. Mississippi law also provides procedures designed to protect the interests of minors when a settlement is reached.

A child’s injuries may involve more than immediate medical treatment. Serious injuries can require follow-up appointments, physical therapy, additional procedures, medication, psychological care, and time away from school or normal activities.

Families should keep copies of medical records, bills, discharge instructions, prescriptions, and other documentation related to the child’s treatment.

Why Is It Important to Preserve Evidence After a Fatal Crash?

Important evidence can disappear quickly following a serious collision.

Vehicles may be towed, repaired, salvaged, or released to insurance companies. Surveillance systems may automatically overwrite older footage. Physical evidence at the crash scene can disappear once the roadway is cleared.

Evidence that may be important in a serious intersection crash can include:

  • Fotografías de la escena del accidente
  • Daños al vehículo
  • Skid marks and other roadway evidence
  • Imágenes de las cámaras de vigilancia
  • Imágenes de la cámara del tablero
  • Declaraciones de los testigos
  • Llamadas al 911
  • Police and investigative reports
  • Datos electrónicos del vehículo
  • Cell phone records when legally obtainable
  • Vehicle and child-restraint inspections

An attorney can take steps to preserve evidence and investigate the circumstances surrounding a crash before important information is lost.

¿Cómo funciona la culpa comparativa en el sistema Mississippi?

Mississippi follows a modified comparative fault system.

Bajo Código Mississippi, sección 11-7-15, a person’s recovery can be reduced based on their percentage of fault. A claimant whose share of fault is greater than 50 percent generally cannot recover damages.

In a crash involving a child passenger, the child’s conduct is generally very different from the conduct of the drivers involved. The facts of each case must still be investigated carefully before responsibility can be determined.

Importantly, authorities have not announced who caused the October 5 Clay County crash. The initial news report should not be treated as a final determination of fault.

Who Could Be Responsible for a Highway 50 Crash?

The person responsible for a crash depends on the evidence.

Dependiendo de lo que descubran los investigadores, entre las partes potencialmente responsables podrían figurar:

  • A negligent driver
  • El propietario de un vehículo
  • An employer if a driver was working
  • A vehicle or parts manufacturer if a defect contributed
  • A maintenance provider
  • Another party whose conduct contributed to the crash

In some circumstances, a dangerous roadway condition may also raise questions involving a governmental entity. Claims involving government entities can have additional requirements and deadlines, making early legal advice especially important.

At this stage, no additional potentially responsible party has been identified in public reporting concerning the Highway 50 crash.

What Should Families Do After a Serious Car Crash?

Families dealing with a fatal or serious-injury crash should focus first on medical care and the safety of their loved ones.

After a crash, consider taking the following steps:

  1. Seek medical attention and follow all treatment instructions.
  2. Keep medical records, bills, prescriptions, and discharge paperwork.
  3. Request the crash report number and identify the investigating agency.
  4. Preserve photographs and videos from the crash.
  5. Write down the names and contact information of witnesses.
  6. Keep information about towing and vehicle storage.
  7. Preserve damaged car seats and booster seats rather than throwing them away.
  8. Save all letters, emails, and other communications from insurance companies.
  9. Avoid giving a recorded statement before speaking with an attorney.
  10. Speak with a lawyer promptly if the crash resulted in a death or serious injury.

Evidence preservation is particularly important after a fatal crash because families may not know immediately what information will become important later.

How Long Do Families Have to File a Mississippi Car Accident Claim?

Mississippi generally provides a three-year statute of limitations for many personal injury claims under Mississippi Code Section 15-1-49.

Wrongful death claims can involve additional legal considerations, and claims involving governmental entities may have shorter notice requirements and different deadlines.

The existence of a filing deadline does not mean families should wait to investigate a crash. Important evidence can disappear long before a lawsuit deadline arrives.

Speaking with an attorney early can help families understand which deadlines apply to their particular situation.
