Your Rights and Covid-19 Related Travel Cancellations

Covid-19 Related Travel Cancellations

As the Coronavirus continues to spread, many companies, such as airlines, are having Covid-19 related travel cancellations that customers have already purchased tickets for. Some consumers are not being offered a refund. Instead, airlines and other travel companies are forcing consumers to accept vouchers that can only be used with that specific airline and expire within a short period of time. Given the uncertainty surrounding the global pandemic, refusing refunds and instead requiring customers to travel within a short period of time when it still may not be safe to travel or lose out on their entire purchase amounts to a breach of the contract...

Supreme Court Upholds Robo-Calls Ban

Supreme Court Upholds Robo Calls Ban

On July 6th, the United States Supreme Court upheld the provision of the Telephone Consumer Protection Act (TCPA) that gives citizens the right to stop unwanted robocalls and text messages to their cell phones. The case, which was brought forward by a group of robo-callers, challenged the constitutionality of the TCPA based on the presence of a provision added to the law in 2015 exempting calls made to collect government debt. The robo-callers argued that the exemption was a content-based restriction on speech that violated the first amendment. They also stated that as a result, the protection against unwanted robocalls...

Credible Fear Interview Preparation

Credible Fear

Know someone who is Detained and Interested in Seeking Asylum? When people are detained by the United States government, they must receive a positive credible fear determination from their Credible Fear Interview to be able to pursue claims to asylum or withholding of removal. At the interview, the asylum officer will ask questions, either in person or via telephonic or satellite communication. An interpreter will be present to translate the questions into the detainee’s native language. Preparation for the credible fear screening process is critical. If one cannot establish positive credible fear, a request can be made to have an immigration judge review...

Why You Should Never Just Settle With Your Insurance Company

Insurance Company Signing

Many Workers Compensation and Personal Injury cases in Mississippi are settled everyday with no attorney involvement between an injured person and an insurance company adjuster. It makes us cringe to know how easy it is to get good advice from a very skilled and experienced Injury lawyer before signing on that dotted line, yet still people just want to get it over with as quick as possible. Usually it is because you may be thinking an injury attorney will take most of the money or an injury attorney probably cannot get more money for you after fees. You also may be...

Stopping Robo-Calls

Robo-Calls

Our partner firm, Chhabra Gibbs & Herrington PLLC, writes about putting a stop to the annoying robo-calls and unsolicited texts in our latest blog. Robo-calls are calls made to consumers using a prerecorded voice message, or mass text. These calls are often made in an attempt to persuade consumers to purchase goods or services from the company behind the calls. Although some robo-calls are made by legitimate companies, including car dealerships, some of these calls may be scams made by individuals or entities in an attempt to convince consumers to hand over personal or financial information. Either way, these calls and...

Recall on Zantac

zantac recall

Our Partner Firm, Chhabra Gibbs & Herrington PLLC, wrote about the recent Zantac recall and how the FDA has decided to pull all of the Zantac product off the shelf due to NDMA and cancer from contamination: The heartburn and ulcer medication Zantac, also known as Ranitidine, which belongs to the histamine-2 blockers category, has been recalled by the FDA.   The FDA has been investigating Zantac for a contaminant known as N-Nitrosodimethylamine (NDMA) in ranitidine medications.  The FDA has determined that the impurity increases over time and when stored at higher than room temperatures, that impurity exposes consumers to an unacceptable level of it....

As Congress passes stimulus bills to prop up our declining economy due to the Coronavirus (COVID-19), many employees are nervous about how the virus may affect their job status.
