The Lea County Sheriff’s Office says two commercial drivers died early Thursday near Jal, New Mexico. One semi failed to stop at Orla Road and struck another semi on Highway 128.

What Happened on Highway 128 Near Jal?
The crash happened about 1:30 a.m. Thursday, October 15, 2026, at New Mexico Highway 128 and Orla Road near Jal. Deputies arrived about 1:47 a.m. First Alert 7 (KOSA) and NewsWest 9 reported the sheriff’s office findings.
A preliminary investigation found that a commercial truck was traveling north on Orla Road when it failed to stop at the stop sign. That truck struck a westbound commercial truck on Highway 128. Both vehicles left the roadway and entered the bar ditch on the north side of the intersection.
Deputies found both trucks fully engulfed in flames. One truck was hauling flammable materials, and those materials caught fire after the impact. The Jal Fire Department put the fire out. Both drivers were pronounced dead at the scene.
One driver was 34 years old and from Alton, Texas. The other was 46 years old and from Sanford, North Carolina. The sheriff’s office says the crash remains under investigation. Officials have not announced charges or named the trucking companies involved.
Who Is Responsible When a Semi Runs a Stop Sign?
A driver who enters a controlled intersection without stopping can create a deadly risk for anyone already in the intersection. At night, a loaded commercial truck needs even more distance to stop. A stop sign semi crash lawyer asks why the northbound truck did not stop.
Fatigue, distraction, speed, mechanical brake problems, and poor visibility can all play a role. Investigators have not said which of these factors, if any, applied here. The preliminary report still matters. It shows how the crash unfolded and who entered the intersection first.
The truck driver may face claims if careless driving caused the wreck. The motor carrier usually answers for a driver working on its behalf. A company can also face claims over hiring, training, dispatch, or maintenance. Our guide to how trucking company liability works explains these claims.
New Mexico law would govern claims from this crash. That state sets its own fault and damages rules, and exceptions may apply.
Why Does a Flammable Cargo Fire Change the Case?
A fire after a truck crash destroys evidence and raises new questions. Hazardous materials rules can require special placards, training, and routing. Investigators will look at what the westbound truck was hauling and how it was secured.
Federal hazardous materials rules sit in 49 CFR Subchapter C. Maintenance duties appear in 49 CFR Part 396. Hours-of-service limits in 49 CFR Part 395 matter on a 1:30 a.m. run. Our post on how federal trucking regulations affect accident claims covers these rules.
Can a Truck Driver’s Family Bring a Wrongful Death Claim?
When a truck driver dies while working, workers’ compensation death benefits may help the family through the driver’s own employer. Those benefits usually do not cover every loss a family suffers.
A separate claim may exist against another company whose driver or equipment caused the crash. Lawyers call this a third-party claim. The employer’s insurer may also seek repayment from any recovery, and exceptions may apply.
Wrongful death claims follow state law. Rules on who may file, which losses count, and how long a family has can vary. Some notice deadlines are short. Our wrongful death lawyer page explains how these claims usually move forward.
Why Call a Stop Sign Semi Crash Lawyer Early?
Evidence after a commercial crash can disappear fast. Tow crews remove both trucks. Burned trailers get scrapped. Electronic data can record over itself.
A stop sign semi crash attorney can send preservation letters to each carrier right away. Those letters ask the company to keep the trucks, engine control module data, electronic logging device records, and any dash camera video. Dispatch notes, cargo documents, and inspection reports can show fatigue risk and load type. Our article on evidence that can strengthen an injury claim explains what to save.
What Should a Family Do After a Fatal Semi Crash?
Ask the sheriff’s office for the crash report number. Keep funeral bills, medical records, and insurance letters in one place. Write down the names of any witnesses. If the driver was working, give the employer written notice of the death. Do not give a recorded statement to another company’s insurer before talking with a stop sign semi crash lawyer. Do not sign a release early.
