All courts have different ways of setting hearings. Some counties have more judges than other counties have. Some courts have more cases than other courts have. Some judges only set hearings on certain days of the week. Some courts have more court reporters available for hearings that have to be on the record than other courts do. When there is more than one party to a hearing, all parties have to agree on a certain date. All of these things have an effect on how long you will have to wait for a hearing date on your case.

I handle a lot of Social Security disability and Chancery Court matters, along with some in Circuit Court as well for personal injury cases.

For Social Security Disability cases, unfortunately, this is the longest wait for a hearing. However, on a positive note, the delay in getting a hearing is improving. Several years ago, I had a few cases take almost 2 years before they were set for a hearing due to the backlog with Social Security and the average was about 15-18 months before a hearing was set. This past year, I have noticed that average has dropped to about 9-12 months, which is a really good thing for the clients waiting to see if they will be approved for disability.

In Chancery Court, the time to get a hearing varies. If it is a simple, uncontested matter that does not need to be on the record where a court reporter is needed, you can generally get a hearing within a few weeks. If it is required to be on the record it usually takes several weeks to several months to get a hearing, depending on how busy that specific court’s docket is at that time.

CoVid-19 has likely had an effect on hearings dates as well, although, in my experience, it has not held up any of my hearings. Judges have been very proactive by holding telephonic hearings when in person hearings were not possible and allowing attorneys to submit other matters by mail or email.

My advice to my clients is to just be patient. When you are working with the courts and other attorneys representing another party, it is sometimes hard to find a date that works for everyone, but we are always working to get you the quickest hearing possible.

There are different rules for different types of legal notices in the state of Mississippi. I will address the 2 most common legal notices below.

Sometimes a person is sued but they cannot be located to be personally served. For example, you have experienced a personal injury in Mississippi such as a slip and fall at a business or someone’s property or a car wreck on I-55 or even a pedestrian accident in downtown Jackson, and you are hiring an attorney to represent you in your personal injury case. You have to find the right person to sue in your personal injury case. The Mississippi Rules of Civil Procedure allow for people who cannot be found to be served by publishing a summons in a newspaper in the county where they live for 3 consecutive weeks. When there is no newspaper in the county in which the defendant is believed to live, then the summons must be posted at the courthouse door and published in a public newspaper of an adjoining county or in the newspaper published in the state capital.

Summons by Publication in Mississippi are also required for things such as notifying potential creditors when an estate has been opened for someone who has died. When you are looking for a legal notice for an estate and there is no newspaper in your county, where should you search? For this type of legal notice publication, the administrator for the estate is required to post the notice to creditors at the courthouse door and 3 other places of public resort in the county. If you are looking for this type of notice, you can always call the Chancery Clerk in the county where you believe an estate has been opened and they can tell you whether an estate has even been opened for an individual. You can then review the court file to determine what all has happened in a case, including whether a notice to creditors has been published or posted, as the administrator is required to file an affidavit stating that either publication or posting has been done.

In order to be eligible for social security disability benefits in the state of Mississippi, you must prove that you have a disability that keeps you from working at a substantial gainful activity level for a period of at least 12 months. The disability must have lasted or be expected to last at least 12 months.

Most of the clients I have assisted at Chhabra, Gibbs Gustavis, P.A. have usually already been unable to work for at least 12 months by the time they apply for social security disability. Many have had previous worker’s compensation or personal injuries and have gone through medical treatment during the course of their treatment for those injuries. It is extremely important not just to rely on previous treatment and to get continuing treatment for the issues that cause you to be disabled. You cannot just rely on a doctor saying once that you can’t go back to work or that you have certain restrictions. You must be able to show that your restrictions or inability to work continues. The only way to do this is to continue treatment for those issues to show social security that you continue to have problems in these areas. Social security judges need to see continuing medical treatment documenting the problems you claim keep you from being able to work in order for them to be able to find you disabled.
